In recent years there has been more car shows and an annual American Graffiti Cruising Parade and Festival. And, although these are great things to have, the actual act of cruising remains illegal in Modesto, California 25 years after the law was written. The festivals, car shows, and parade celebrate an act which is still, in reality illegal. There are signs posted year round on McHenry Ave. which read 'Cruising Prohibited' and 'Cruising & Loitering Prohibited.' Which is probably not the best welcome signs for people coming to the city to celebrate cruising and the classic car culture. We here at Modesto News .org believe it is time to throw out this law. Kauffman, a known scrap metal thief, was allegedly shot dead while trying to steal an antique car from Carson's house in March 2012, according to a police affidavit obtained by DailyMail.com. His body was then secretly removed from the property and dumped in rural Mariposa County near Yosemite National Park. It was discovered by hunters in August 2013, sparking a murder inquiry. On Friday, Carson was arrested alongside his wife, Georgia Defilippo, 63, daughter, Christina Defilippo, 36, three California Highway Patrol officers and two liquor store owners in Turlock. A ninth suspect, Robert Lee Woody, was arrested and charged with murder in the case last year. The thief was taking these from storage containers on his property, Carson thought. The lawyer had grown angry with people repeatedly stealing items from his Turlock house - and wanted revenge, according to the 325-page Stanislaus County Sheriff's Department affidavit. The attorney was 'actively trying to catch anybody who came on to his property' at the time that Kauffman was killed - and had reportedly even previously threatened the thief's friend with death. He had told Michael Cooley, whom he also believed was stealing from him, 'If I f***ing catch you... or any of your f***ing friends over on my property I will kill you,' a neighbor claims in the affidavit. Cooley was with Kauffman, a neighbor of Carson, on the night of March 29, 2012, when the pair reportedly discussed sneaking onto Carson's property to steal irrigation equipment from him. According to Woody's son, Robert Woody Jr, the two men also planned to steal an antique car. The duo jumped over Carson's fence, but were unaware that Woody and the two store owners charged in the case - Baljit Athwal and Daljit Atwal - were on the property, Woody Jr told police. When they realized, Woody and a third would-be thief - who has not been identified - then backed out and leaped back over the fence, it is said. However, Kauffman apparently did not do so. Woody Jr said his father had told him he then heard gun shots ring out from the residence - where Carson is also believed to have been present - and that these resulted in the death of Kauffman. Woody later told his son that the thief's body had been removed from the house and taken to 'the mountains near Yosemite National Park', where it was found 17 months later, the affidavit states. Following Kauffman's killing, three California Highway Patrol officers apparently obstructed the investigation by giving false information due to their friendships with the suspects, it is reported. Until this week, Woody was the only person charged in relation to the alleged murder and cover-up. But now, Carson is facing a first-degree murder charge, along with counts of criminal conspiracy, false imprisonment and two counts of soliciting a crime. He denies any involvement in the killing.
